1. Introduction
By hiring Vivid Design Build LLC or using our website, you agree to these Terms and Conditions. If you do not agree, please do not use our services.
2. Services & The "Free Demo"
We provide web design, branding, and digital content services (including logos, doodle videos, and voice overs).
- Free Demo Policy: We offer a complimentary website demo to prospective clients. Vivid Design Build LLC retains full ownership and copyright of the demo design. You may not use, copy, or publish the demo unless you enter into a paid agreement with us.
3. Payments & Billing
- Invoices: All invoices are due upon receipt unless otherwise specified in your contract.
- Subscriptions: If you are on a monthly website package, failure to pay may result in the temporary suspension of your website until the balance is cleared.
- Refunds: Due to the custom nature of our work, deposits and setup fees are non-refundable once work has commenced.
4. Intellectual Property
- Client Ownership: Upon full payment, you own the final website design, images, and video assets created for you.
- Agency Rights: Vivid Design Build LLC retains the right to display your project in our portfolio and social media for marketing purposes.
- Client Materials: You represent that you own the rights to any text, images, or media you provide to us for use on your site.
5. Limitation of Liability
Vivid Design Build LLC is not liable for any direct, indirect, or consequential damages arising from the use of your website, including temporary downtime, security breaches, or loss of business revenue.
6. SMS & Communication
By providing your phone number, you consent to receive text messages regarding your project status (e.g., "Your demo is ready"). You may opt out at any time by replying STOP. Message and data rates may apply.
7. Governing Law
These terms are governed by the laws of the State of Florida and the United States.
